TRUMP INDICTMENT

When he was calling for Hillary's head over her handling of TS documents, he should have learned from her and the others before him to say, "Oh, my bad, I didn't know they were there, here, you can have them back". They're all scum, and frankly it shocks me that security is so loose with these docs, Biden, Trump, Obama, GWB, and probably all of them before that did it as well, meanwhile some dipshit that takes a pic of a submarine gets 3 years (IIRC).
 
Am I the only one who thinks he is semi complicit in this being in the news right now? Assuming he isn’t actually convicted, he is eating up all the media coverage during the start of DeSantis’s campaign. He ends up looking oppressed by the left as always…

The president cant mis handle classified material because he is the one that declassifies it.

Trump added to the confusion when he said in an interview with Fox personality Sean Hannity, “There doesn’t have to be a process, as I understand it. ... If you’re the president of the United States, you can declassify just by saying it’s declassified. Even by thinking about it.”

Most national security legal experts dismissed the former president’s suggestion that he could declassify documents simply by thinking about it. But as an ABA Legal Fact Check posted Oct. 17 explains, legal guidelines support his contention that presidents have broad authority to formally declassify most documents that are not statutorily protected, while they are in office.

The system of classifying national security documents is largely a bureaucratic process used by the federal government to control how executive branch officials handle information, whose release could cause the country harm. The government has, however, prosecuted cases for both mistaken and deliberate mishandling of information. Under the U.S. Constitution, the president as commander in chief is given broad powers to classify and declassify such information, often through use of executive orders.

Some secrets, such as information related to nuclear weapons, are handled separately under a specific statutory scheme that Congress has adopted under the Atomic Energy Act. Those secrets cannot be automatically declassified by the president alone and require, by law, extensive consultation with executive branch agencies.

In all cases, however, a formal procedure is required so governmental agencies know with certainty what has been declassified and decisions memorialized. A federal appeals court in a 2020 Freedom of Information Act case, New York Times v. CIA, underscored that point: “Declassification cannot occur unless designated officials follow specified procedures,” the court said.

Did you read the last paragraph from the ABA? The president is not a King, there are still procedures that must be followed, not just thinking about it and boom, they're declassified!

Sounds like Trump didn't understand that and neither do you.

Steven Aftergood, director of the Federation of American Scientists Project on Government Secrecy, said that such authority gives the president the authority to "classify and declassify at will."

According a federal Judge in a Bill Clinton Classified tapes in his Sock drawer case, The president has the final say, The [Presidential Records Act] does not confer any mandatory or even discretional authority on the archivist,” wrote U.S. District Judge Amy Berman Jackson in that 2012 ruling. “Under the statute, this responsibility is left solely to the president.”

This ruling was never appealed or disputed, therefore sets case precedence.

He is on audio admitting that the docs are classified. He is not the president anymore to declassify them (which is why he is throwing the "I thought it so therefore they are nonsense). He shows them to a reporter/writer. Fucked. Game. Set. Match. DeSantis.

There are endless cases to be made that others have done similar or worse. However, that doesn't matter. Your legal defense can't be Yes sir, I stabbed her 24 times but I read about a guy that stabbed a woman 45 times.

His best hope if the above is true is that the case moved to Florida instead of DC. Jury pool will be much different

I'm a huge supporter and I've always admired how he tees everything up and seems to always be on point. Always felt he had good instincts. The recordings suck, I'm surprised they took place in a way they could be listened too later against him.

Also heard something about a pool drainage flooding the security camera room🤷‍♂️

Right, so when did he declassify them? I'm guessing never. And now he's a private citizen he can't.

Why?

The POTUS is elected by the people and should be able to make information available to the people outside of threatening troop safety or national security.

The only reason I would vote for Trump at this point is the hope that he would declassify everything other than items that would endanger troops and burn it to the ground.

Here's the thing with that, it doesn't matter if you agree with it or not. POTUS has original classification authority and can declassify anything at any time. Just as they can issue a Presidential Pardon. POTUS has an enormous amount of executive privilege, no matter who it is.
