But also, I have questions. If the renter WAS paying rent... wouldn't the homeowner still be living in a van down by the river, just $50k richer? It's not like the police came by one day, threw him out and forced him to rent out his only home to someone against his will. Seems like there's a lot of the story that's not being told by the news or by the property owner.

You realize NOT collecting the rent but still paying the mortgage along with utilities can put the guy behind the 8 ball.

Much like MN - once the renter is in, he/she has more rights than the landlord. Likely the owner went back after the term of the rental and the renter didn't allow him in...

Presumably the owner would have enough money to pay for flight school and an apartment or room if the renter had continued to pay rent.

But he's training to be a pilot, so he's likely a cheap, drunk, weirdo. :flipoff2:

It wasn't always an airbnb. tenant got the rental license AFTER he was delinquent in rent.
Could have been an owner lived in duplex prior.

If it wasnt for bankruptcy laws my neighbor would be homeless while her tennants havent paid rent for over 2 years (the place im trying to buy). She is in her late 60s working 70+hrs a week because of her tennants

My father-in-law has some wild rental stories. He had some renters illegally cutting down trees in the area and cutting up the logs for firewood in the living room of one of his places. Says they were pretty rough guys at the time, so to avoid pissing them off when he evicted them and having them trash the place when they moved out, he rolled in with a case of beer and couple of joints. Partied with them and then dropped the news he had to have them move out. It went well.

He had a duplex in Hawaii where he lived in half and rented the other half to his surfer bros. One night his renters partied a little too hard and accidentally blew a hole the wall between the duplex with a shotgun. He lucked out and wasn't home at the time.

He had another lady living the rental house he wanted to used to start a family once his wife got pregnant. She refused to move out, so he told her cool, he and his wife and new baby were just going to move in upstairs, and had a buddy pretend to be a contractor and come through the house taking measurements to put in a door for the stairs and had him start talking about partitioning up the kitchen. She left quick. I don't think you can pull that one off anymore.

Who gives a fuck if he was living there. It's his property, someone that isn't paying the agreed upon rent is living there AND using it commercially, and guy can't evict them for 12 months?

This isn't a law problem, this is a city bureaucracy problem, and nobody should like that shit regardless of the situation. They fucked up giving the permit in the first place, now they're fucking up how long it takes to evict someone. Shit should take 30 days, fucking tops.
 
Some shit like that happened to me I can't tell you what would happen but I promise it would be deemed inappropriate and irrational.
I feel like this is a case where the Mafia is the proper solution. But then you're on the hook to the Mafia. :laughing:
 
it is probably all true. I live in a small town, I'm told we can't use lead bullets out at the ranch, but other than that, I don't notice that much going on that is out of the ordinary. Don't notice much difference when reps or dems are governor. I go to see my brother ,who lives in the city, about every month... he lives in a really nice house in a nice neighborhood. No homeless there. I work in an 'impacted area' (poor people) and we have homeless and all the problems that come with it.

the reasons for the homeless is so broad, one solution doesn't work, so, that part sucks. expensive gas... yep. taxes... yep. If you are able to make enough dough, you don't feel it compared to how nice it is to live here. Whatever idiocy California comes up with seems to eventually transfer to the rest of the states in time (smoking laws etc, safety laws etc) so, maybe we are just patient zero.

I went over to meet the solar guy at my aunt's in San Martin yesterday. She bought a hybrid car and wants a solar system now. She has some old panels that are all fucked up and it was fun to look at the whole thing and figure it out with the guy. We laughed about all the different rules and changed legislation and requirements... it is like a maze or a puzzle. But, we'll figure it out.

Here is one that will make eyes roll... at our cabin, there are neighborhoods all over the lake with owner's associations. I'm the president of ours (a thankless and retarded job that is the result of some sin committed in some previous life) anyway, we have a road that is paved (rare up there) and it ends with a trail head (two actually) and a local, historic business. We are applying for grant funds to repave the road (and reengineer parts that were not done right in the first place) and the 'winning' concept according to the people helping me 'make it about making it easy for hikers and it will get more tractiion.'

Pave a road to help hikers.

I saw a post where someone said they have the news on all day. Fuck that. I watch 30 mins a day and read the news on the internet for about 30 more minutes. Any more than that and it melts your brain (worse than eggs on drugs)

Spend the extra time left by not wasting it on the news making stuff or figuring out simple ways to make more dough so that when gas is 6.00 it is a minor annoyance.

I'm regularly blown away that people don't simply fix all their problems by just being more wealthy.
 
Yeah rentals can be a bitch and I hate that the states do not allow you to evict them for non payment. My boss had to sell 2 homes after COVID because one didnt pay for a full year and the other one didnt pay for like 6 months.

Wife has a condo rented by some college kids, going well. We split up our two story house and rented out the bottom to my mom. She got livid pissed when we asked to increase the rent..... We didnt end up doing that. Luckily she's buying a place on the other side of the mountains. Rents going up! :homer:

I respectfully disagree. It is 100% a law problem. In California, the only way to evict a renter is to file a lawsuit against them, and then wait for the court to order law enforcement to carry out the eviction. An overloaded court adds to the problem, but it's not the root cause.

The thing is, this isn't some unheard of issue the dude is having. If you're a landlord in California, you have to know this is a risk you're assuming every time you rent out a property. This guy is upset, but really it's known in the state that evictions take a long ass time. Shit should take 30 days tops, but around here, it don't.

NO ONE in their right mind would think a squatter can legally re-rent someone else's property.

Renters need some protection. Would suck to have made the house you're renting a home, be paying rent, and minding your business, only to have the land lord tell you that you have to be out tomorrow with no warning or reason.

In this case of course, there's too much protection and a dirtbag is taking advantage of it.

Not at all a gray area. Either the owner owns the home or the government does...


your example can be handled in contract law. Government's only responsibility is to ensure contracts are enforced
