What's new

Vaccination mandates on the horizon.

Just got word that my religious accommodation was approved. I'll be required to mask and test weekly on my own time and my own dime.
Ours was just suspended. Completely shocked me. I'm still leaving, but it's nice to not have the "best by date" of Jan 4th.

Its not OK. Block the number? I am sure they have multiple numbers. Many robo tex/call places do. Keep blocking them they will probably stop soon.
Id rather call them and tell them its not ok. In a cheerful manner

Heard a rumor today that utilities are going to be exempt all of a sudden. Haven't got the official e mail yet. Last one basically said you will get the shot or be let go, no testing and exemptions will be reviewed by lawyers. I'm wondering if the gov figured out all the lineman and power production people were gonna walk. And they were about to get the dark winter they always talk about.

Thank goodness for equal protection under the law

Agreed. But it hasnt been equal since the start. Goverment is exempt. Post office ect...Wife's a RN and just got the December 5th date or else. I had to remind some people today, that even if we are exempt they can change it back whenever. we need to keep fighting for everyone else that is still affected. What we are hearing supposedly exempts anyone who has a federal contract. Anyone heard anything like this?

What government gives, government can take away

Our HR is saying the opposite, that .gov contractors or contract servicers are required to be vax'd so even if the OSHA mandate is on hold (and they were arguing till being force-fed a screenshot of OSHA's own site saying they were abiding by the fifth circuit ruling, that the fifth circuit ruling didn't overrule fed OSHA) the fed contractor garbage is still in play and we still need to get your vax card and blahblahblah.

For even more fun, the mandate from HR hit after I left on vacation, it is due before I get back, and the same HR VP who said it's mandatory has also already told me "I suppose you can just not fill it out and we'll proceed with our planning on the assumption that you're not vax'd".

The HR doublespeak I've seen over the past few days rivals the Rittenhouse prosecutor's antics. Vax'd or not the bullshit makes me want to make everybody trying to inflict this shit, have a more difficult day in whatever small ways I can.

So OSHA mandate isn't primary for my work, the EO is. Just got this yesterday,

(snip)

Recently, the Biden Administration announced they were extending the deadline for the COVID-19 vaccination requirements for federal contractors, and covered contractor employees must be fully vaccinated no later than Jan. 18, 2022.

In implementing the recently issued Executive Order providing for federal contractors to be fully vaccinated no later than Jan. 18, 2022, we are requiring our U.S.-based employees to provide proof of vaccination status. This vaccination requirement applies to our employees in the U.S., including those who are currently working remotely.

(end snip)

Anyone else get this? We are over 90,000+ and maybe 70% vaxed?
Has anyone seen anything about the extension?

We got the same EO>OSHA.

We got the same EO>OSHA.
An executive order has ZERO legal standing. All it can do is instruct an entity that reports to the executive branch (OSHA) to do something. If the thing that the EO orders the dept to do is ruled invalid, then the EO itself is invalid. There is no gray area here. It has NO LEGAL AUTHORITY.

This is what my work HR is citing in their "have to get your vax card in" push after being shown that OSHA can't/won't go there. They're still (well, the head of HR is, everybody under her thinks she's a nut) claiming that all the fifth circuit did was delay it for a week or two, and the next ruling will reinstate it, and same timeline, and etc.

We're not materially a federal contractor anyway, we sell only very incidentally to the feds, and what we do sell, should by rights be sold through dealers (and typically is) or is otherwise a step removed from direct contracting.

Call her bluff. Don't submit and if it is short down sure her ass. Make it hurt for the company. Or have someone above her tell her to knock it off.

I'm not about to attempt to argue that with my CEO or OGC, regardless of accuracy.

Spoke with my boss yesterday afternoon. I'm supposed to be contacted today regarding my religious accommodation. "IF" it is granted then the current requirement is to be tested weekly and on my own time and dime. We'll see what happens.
In wi there is a law on the books stating that if there is a medical procedure or test required for employment the employer has to cover it.

The dwd in wi says that rule doesn’t apply to Covid. It’s currently being challenged in court. Her company is now paying for the testing and paying wages to get tested. It’s a fucking mess. Leave it up to a potato and his groupies to fuck this all up.

The company I work for was considered a federally chartered corporation until two weeks ago, now we are (suddeny) a Federal contractor, I am told that as such we are covered by the federal E.O, so nothing has changed for us regarding the mandate. We were also told multiple times we would have to comply with the December 8th date, there has been no mention of the January 18th date whatsoever even though it specifically addresses federal contractors.

They will have to pay for his time and the test if they want it since the EO is 100% dead.

"On November 12, 2021, the U.S. Court of Appeals for the Fifth Circuit granted a motion to stay OSHA's COVID-19 Vaccination and Testing Emergency Temporary Standard, published on November 5, 2021 (86 Fed. Reg. 61402) ("ETS"). The court ordered that OSHA "take no steps to implement or enforce" the ETS "until further court order." While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation."
The op doesn’t fall under the osha rule. He falls under slow Joe’s order.

Believe the 6th Circuit court was selected on Tuesday to hear some remaining EO vax cases, including one specifically pertaining to federal contractors. The 6th is a conservative court, so there is a chance that a good ruling will result.

hopefully it comes back pretty fast with a ruling and not take 'til March when it won't help anyone fighting this crap

That was the one the 5th already said is dead. Honestly I don't understand some of this.
