Trust issues in CA. Haven't read any of the laws

Maybe an absolutely horrible idea but what about calling up the lawer already working on it and asking whats up.
 
I received a few versions of the trust from that attorney so yes he is representing her and hence the trust.

You received the newest revision of the trust, not a few versions. Contact that attorney and request the most current revision and dispose of any previous versions/revisions as not to confuse yourself or any new attorney that you work with to receive your half of the trust.
 
Same, latest just has the amendment that put me back in as 50% beneficiary.

Precious trust sent 1 year earlier should have as the amendment was signed by both trustors, prior to eithers death.
The amendments are the same date, but say different things and the one you care about was dated a year earlier?? HUH?

Dude... I know you'll ignore this... there are many people here trying to help you. But until you are one of those people it's nothing more than internet entertainment.

Regarding WHICH version of the trust. Don't add bullshit information YOU THINK you know. List what the dates of the "amendment" and the trust itself. Write what that amendment actually says.

Don't go into things you think you know, because reading this thread YOU KNOW NOTHING PAE. Stop injecting your opinion about your sister, about what her "intentions" are, etc. Respond with facts YOU KNOW and go from there. Try the "EXPLAIN IT TO US LIKE WE ARE 5 YEARS OLD" concept.


I swear, his sister is probably on some forum bitching about her freeloading, loser brother who has been living off their parents in a house of theirs and hasn't worked for 4 years. How it's gone off the deep end into conspiracy theories and she just needs to get his freeloading ass out of the house so she can settle the estate and wash her hands of him forever. (to me, this seems like the more plausible scenario the more I read of this trainwreck)

Usually there will also be a date in relation to the signature....so that would be the date/version you would want to read and understand.

My take is the ol'man knew what he was doing when he named the daughter/sister as executor.

I am the first-born/eldest son/eldest grandson and my wife is same on her side. All trusts/living wills have third-parties (ie attys) named as executor to avoid all this shit. There is no rule that it has to be a family member and the skim/rake for their service is worth the lack of headache. You get what you get as named in the trust and that's the final word. There is millions across both families but we set up our lives such that if nothing shows up except some rose bushes and a yellow 1949 Buick Roadmaster, our life is still full and happy. Sorry it's not the same for everyone (I do expect some drama from some of my step-father's kids but I don't care - we are not close).

There has been some top quality nuggets/jewels of information dropped by many members here - I sincerely hope it works out positive - it seems like all the pieces are there for an equitable and even distribution; all things do work out regardless of expectation, so the sooner you unfuck, the more likely a positive outcome will be the result.

If he is being paid by the trust, he represents the trust, which is neither you nor your sister, you fucking potato. If your sister is using the trust to pay him as her personal attorney, they she's violating the law and you need to follow the advice that Grendel's given you about twenty hundred times already.

Then he is not s representative of the trust, he's HER lawyer. You ask for help and then argue and post cryptic messages that we have to read between the lines to understand becsuse you apparently cannot form 2 consecutive coherent thoughts that are related to the same subject.

Not usually in a trust situation. When the current successor trustee hires an attorney, that attorney is representing them, and assisting in the implementation of the trust. When I became the successor trustee of my parent's trust, a letter was sent to my brother and sister telling them the attorney I hired with the trust's money, works for the current successor trustee (me) and if they had any issues they needed to hire their own attorney. That's the way it works. It's too bad because she is a great attorney and now they can't use her for anything, ever.

I also have two current trusts, a family trust and a personal trust. I should have hired a separate attorney to create my personal trust so they could represent me alone if needed. I made the mistake of using the same guy for both trusts and now he cannot represent me separately from my wife as we are both his clients and there would be a conflict of interest. Something he should have made very clear before creating the trusts because I would have done things differently. I had some questions about taxes and my personal trust and I had to talk with another attorney. It worked out because he was cool, a tax, trust and estate law attorney, and didn't charge me for the 30 minutes we were on the phone.

I created the second, offering more sound advice and some ridicule.

Then he created this one and someone renamed it for him for accuracy.

So two by him, and one by me.

Maybe so, but we're a bunch of nosy bastards that love to get up in other peoples shit. Love you guys, but I doubt I'd be coming here for advice in a similar situation. :flipoff2::laughing:
