they're probably too flexible for msha

No they are perfectly fine (kind of suck to use though).

I'm guessing the operator also didn't document it on a pre task inspection, if they did that usually gets you out of annoying citations like that if it was either that day or you can show it's planned to be fixed ASAP.

It was on the daily workplace exam for the last 2 weeks :homer:. It’s been hanging out by the wash ponds so it got forgot about:homer:

Osha hits the job break out the fucked up extension cords quick to keep them busy while cleaning up real violations.
lol that would work if it was a busy site. Yesterday it was me in the haul truck one guy feeding and one guy taking away from the plant. Msha came with 2 guys:eek:. They like to sneak in to surprise you.
 
That unfortunately is an easy one for them cite that occasionally will get you an S&S if the inspector is having a bad day.
I wish they would take the steps off the outside and put them on the inside of the tracks. The 349 has big tow loops on the inside of the track frame and they make a perfect step. There is no way to rip them off.
 
We have been nailed many times over, non original type/ modified or bent steps on equipment.
This is the problem how do I get oem steps for a machine that’s 30years old. Also like I said they have been hit so many times all the threaded holes are destroyed on the track frame itself. It would be a day or two project to cut off the mounts make new ones to make it oem again. If I had a full time mechanic This wouldn’t be a big deal but when I need to do it myself or take a guy off a crusher to do it then it becomes a huge burden.

I’m only a 7 guy operation including me. The stupid thing is I have 5 msha numbers :homer:.

What pissed me off was the inspector was challenging me over if this machine had a rubber step or not. He used the same machine back 15 -20 years ago and it didn’t have a rubber step. I told him he is wrong and here is the parts breakdown from cat. He just pissed me off yesterday.
 
Inspector told a forman that euclid R40 first step had wire enbedded in the rubber from the factory:lmao:
It didnt, said we couldnt replace it with regular ol belt rubber. Company fought it and won that one
