President-elect Donald J. Trump took in the UFC 309 fight Saturday night at Madison Square Garden in New York City, receiving a thunderous ovation as he made a triumphant return to the scene where he held a historic rally ahead of the election.
The crowd roared when Trump entered the arena with his A-list entourage consisting of UFC president Dana White, Elon Musk, Robert F. Kennedy Jr., Tulsi Gabbard, Vivek Ramaswamy, GOP House Speaker Mike Johnson, sons Don Jr. and Eric and Kid Rock
Early Sunday morning, Don Jr. posted a photo of himself aboard Trump Force One, sitting at a table with his father, Musk, and RFK Jr., who Trump has tapped to run the Department of Health and Human Services, pending Senate verification.
But what jumps out in the photo is that the men were enjoying a meal from McDonald’s, including Kennedy, a fitness fanatic who has vowed to “make America healthy again.”


Granted, RFK Jr. doesn’t look too thrilled but when in Rome…

Another aspect of the photo was that House Speaker Mike Johnson (R-LA) managed to squeeze himself into the shot — it was quite the surprise that Johnson accompanied the Trump entourage to MSG.
 
It appears the Senate can do something about it if they choose. In typical Washington fashion though they let it slide so they can point fingers later. Blame the spineless powers that be if you want to blame someone.
Trump asked the Senate majority leader to allow it. He doesn't have to allow it.

"Even under a broad interpretation of the Recess Appointments Clause, the Senate may limit the ability to make recess appointments by exercising its procedural prerogatives. The Court in Noel Canning held that, for the purposes of the Recess Appointments Clause, the Senate is in session when the Senate says it is, provided that, under its own rules, it retains the capacity to transact Senate business.646 In this vein, Noel Canning provides the Senate with the means to prevent recess appointments by a President who attempts to employ the “subsidiary method” for appointing officers of the United States (i. e. , recess appointments) to avoid the “norm”647 for appointment (i. e. , appointment pursuant to the Article II, sec. 2, cl. 2)."

"The Supreme Court affirmed that pro forma sessions are sufficient to prevent recess appointments and addressed other intricacies of the practice in NLRB v. Noel Canning (2014). Appointments made during a recess must be confirmed by the Senate by the end of the next session of Congress, or the appointment expires."
 
Besides the Senate has to be on vacation for 10 days before Trump can conduct a recess appointment so all they have to do apparently is have 1 person come into the office and shake their tallywacker and then go back on vaction to reset the clock.
 
The ability to circumvent shouldn't fucking exist. We elected a president, not an emperor.
But it does exist. Trump didn't create it or even take advantage of it during his first term. Trump got run over a lot trying to get along his first term. It cost him precious time and he was ridiculed for having to get rid of so many people. It looks like he learned something about the rules of the game.
You can ignore this again if you want but he asked, permission doesn't have to be granted. If it is you are blaming the wrong guy.
 
Congress is as much of a problem as the bureaucracy. They've spent 200 years constantly delegating as much responsibility as they can expanding the bureaucracies and the 17th Amendment just exacerbated that by removing state level accountability from Congress. People love to talk about term limits, but they're really not the answer. All you're doing is implementing a revolving door of people who don't care about being re-elected. That just makes them more open to corruption from lobbyists as they have a set limit of time to cash out the position. You can change Senators every 4-8 years, but those lobbyists who pay them aren't going anywhere.

You repeal the 17th, make the state legislatures elect Senators again and that moves the accountability not only back to the state, but you increase local pressure on state legislators with their constituency. If I'm in Nebraska and stuck with a career politician who makes millions in office of inside trading and who knows what else what can I as a citizen do? Not much. But if the state legislature elects him and I can go bitch at my local legislators business, at town halls, at the local diner where he gets breakfast, I can organize boycotts of his local business until he puts pressure on that senator. Now all of a sudden those citizens in Nebraska are a hell of a lot more connected to their state's senator than they were before.
 
Just learned that they'll still have to vote to go on recess, so anyone of them who doesn't want recess appointments will just vote no to go on recess. I believe McConnell has already stated he's going to get in the way of that.

The Trump team continues to roll out Cabinet picks, and on Monday evening, they announced that former Wisconsin congressman Sean Duffy is the president-elect’s choice to become Secretary of Transportation.


If confirmed, he will take the reins from current secretary Pete Buttigieg, who struggled in the role, to put it mildly.

In a campaign email, the Trump-Vance Transition Team praised Duffy:

I am pleased to announce that former Congressman Sean Duffy, from the Great State of Wisconsin, is nominated to serve as the Secretary of Transportation. Sean has been a tremendous and well-liked public servant, starting his career as a District Attorney for Ashland, Wisconsin, and later elected to the U.S. House of Representatives for Wisconsin's 7th Congressional District.
During his time in Congress, Sean was a respected voice and communicator in the Republican Conference, advocating for Fiscal Responsibility, Economic Growth, and Rural Development. Admired across the aisle, Sean worked with Democrats to clear extensive Legislative hurdles to build the largest road and bridge project in Minnesota History.


Duffy is currently a co-host of "The Bottom Line" on Fox Business, as well as a contributor on Fox News. His wife Rachel Campos-Duffy is also a “STAR” on Fox, as the Trump campaign puts it, and they have nine children together.

Sean will use his experience and the relationships he has built over many years in Congress to maintain and rebuild our Nation’s Infrastructure, and fulfill our Mission of ushering in The Golden Age of Travel, focusing on Safety, Efficiency, and Innovation. Importantly, he will greatly elevate the Travel Experience for all Americans!

As the father of a mere four children, I heartily agree with this person’s sentiment:


Of course, since he’s a Trump pick, there were naturally those waiting to “pounce.” This was a pretty effective comeback to Politico’s shot at Duffy:
 
There job is to act as one of checks and balances.
There are three branches of government for a reason, and it’s greater than Donald Trump.

Get them appointed through standard and intended practices.

And there’s no reason to say they won’t pass, which is why Trumps willingness to fuck over constructional intent, when you don’t even need to should concern the shit out of you.

If only the Senators would vote on someone's capabilities instead of their politics...this concept would be great.

In a significant development, a hacker has reportedly obtained transcripts containing testimony that could be damaging to President-elect Donald Trump‘s nominee for attorney general, Matt Gaetz.

The New York Times reports:

An unidentified hacker has gained access to a computer file shared in a secure link among lawyers whose clients have given damaging testimony related to Matt Gaetz, the former Florida congressman who is President-elect Donald J. Trump’s choice to be attorney general, a person with knowledge of the activity said.
The file of 24 exhibits is said to include sworn testimony by a woman who said that she had sex with Mr. Gaetz in 2017 when she was 17, as well as corroborating testimony by a second woman who said that she witnessed the encounter.
The information was downloaded by a person using the name Altam Beezley at 1:23 p.m. on Monday, according to the person, who was not authorized to speak publicly. A lawyer connected to the case sent an email to the address associated with Altam Beezley, only to be informed in an automated reply that the recipient does not exist.
The material does not appear to have been made public by the hacker.

The controversy surrounding Gaetz intensified on Monday after a lawyer for two women claimed to CBS News that Gaetz had allegedly paid them for sex. One of the lawyer’s clients further alleged that she witnessed Gaetz engaging in sexual activity with a minor in 2017.

Amid these allegations, The Times reported that in private discussions, Trump has acknowledged Gaetz faces steep odds of being confirmed by the Senate:

It is possible that enough Republican senators are willing to risk their careers to oppose Mr. Gaetz, although it is unclear what the backup plan would be should Mr. Gaetz falter. Mr. Trump’s personal lawyer and pick for deputy attorney general, Todd Blanche, is seen as a possibility.

Hours after Mr. Trump announced his selection as attorney general, Mr. Gaetz resigned from his seat as a House member from Florida, which effectively ended the investigation. But there is building pressure on the Ethics Committee to release a report on the inquiry.
The question has repeatedly come up in Washington about the vetting done for Mr. Trump’s nominees. The question misses the point. Little more than a cursory Google search would have shown that Mr. Gaetz, Ms. Gabbard and Mr. Kennedy would draw all kinds of protests. Mr. Trump nominated them anyway.
Despite this, Trump has reportedly shown no intention of withdrawing Gaetz’s nomination.
