Duh. The whole point of "emergency powers" is to end run around the constituion. Just about every governor in the country has been thumbing their nose at both state and federal constitutions for months.

Every time a piece of shit president signs an executive order it’s pissing in the face of our republic. “I’ve got a pen, and a phone” Fuck anyone and everyone who is ok with EO’s, fuck you even more if you were fine with Obama doing it but not DT. Same if you’re fine with DT doing it but not the Dems the next time their in power.

This. I wish that SCOTUS would make a ruling that E.O.s are unconstitutional. Both sides make a mockery of COTUS by their use.

The only E.O. That pertain to the executive branch should be allowed. This is the only place the president has complete power over.

I'd prefer they not happen for any kind of Policy change. They are proving really hard to undo once enacted in things like DACA.

Only way to get that would be for Congress to do their JOB! I think they like E.O.s as it gives them political cover to either rail against them or support them without getting their hands dirty.

Remember, govt authority requires the citizens to comply. Just because there is paperwork in place to allow an endrun on the constitution, the people need to accept it as necessary to deal with some problem. If it happens without sufficient reason, the willingness to comply will likely turn to a willingness to do something else.

Yes. And I am totally for decreasing power of the Federal government in general; i.e. as originally intended by the Constitution. It is my belief that Federal hegemony is largely a consequence of the ability to deficit spend. Get spending in line and the Federal government's ability to strong arm the States goes away.

In an attempt to totally derail this thread- why do you think this hasn't happened yet? Is it because the general population doesn't care? Or isn't aware that of the problem? Or that they actually want the feds to have more control than the states?

Dunno about Eric, but I suspect most people are happy with the economic swell that accompanies debt spending and have turned a blind eye to the downsides hoping that it will either just go away or not become a problem until after they have died.

That and the modern desire for instant gratification has lead many to want a Benevolent God for a government. Can't afford X? No worries. GOVT to the rescue! Don't like that people are mean to some group. No worries! GOVT will fix it!

POTUS is the weakest of the 3 branches of government by a lot.

COTUS grants the President broad powers under the Faithful Execution Clause, Article II. This has been WIDELY and STRONGLY upheld by SCOTUS and Congress, with tens of thousands of precedents.

E.O.s are run through a series of GROUPS of lawyers because it is so hard to make an executive decision in the US. First they are drafted by White House lawyers on the President's staff, then they are sent to the Justice Department for review/remark, then back to the WH where a different set of lawyers from the first, the White House legal counsel, revises the text. Then BACK to the Justice Department for final review, then they are issued.

POTUS's biggest powers are his War Powers, the ability to convene AND ADJOURN both houses of Congress (which is basically the power of a King, as the Monarch of the United Kingdom holds the same power over Parliament, that goes back to the Magna Carta), and the Bully Pulpit.

As for the last, POTUS does not even have the Franking Privilege (the ability to mass-mail for free, which every member of Congress has, both Houses).

The biggest Presidential over-reaches that have occurred are Lincoln's suspension of the writ of habeus corpus (the Union Army could arrest anyone without representation, bail, or even a charge), and FDR's flurry of EOs regarding the Depression (which just about in the US wanted because they were all desperate).

So, when POTUS convenes both house of Congress and posts federal troops outside to lock them in, you'll know that the Prez is up to some serious shit. AFAIK that has never been done.

POTUS is literally the softest touch office in the Federal Government. SCOTUS has the power to sweep down vast fields of Federal Law, and Congress runs the entire show, because they wrote COTUS.

None of the above. The general population is too stupid to think or act based on principle. Instead, the general population is dominated by lazy .gov tit sucking leeches who don't give a fawk about anything except keeping the mothers milk flowing. Its escalated to the point now where the leeches are parading through neighborhoods demanding that hardworking AMERICANS give up their homes and businesses. The end game will not be socialist utopia.

I would not go this far. In principle, EO's are an extension of the executive branches responsibility to implement policies that have been passed by Congress and signed by the President. Most, if not all, EO's are vetted by lawyers and fall within the executive branches prerogative. As I see it, the problem is that for those EO's that do overreach the burden for judicial review is too high. Typically, standing to challenge an EO requires that somebody must first be aggrieved by the order but by this time it means you have already been arrested, jailed, or otherwise lost your livelihood. Furthermore, the aggrieved is responsible for funding a legal challenge which is beyond the means of most. I'd prefer to see automatic review of EO's by SCOTUS.

You have a different perspective on this an I do. It sounds like you believe the average american is now a government teat sucker and that hardworking Americans are in the minority? Did I get that right? I was under the impression the opposite was true, but I have no data to back that up, I was just going by general observation in my day to day life. I also don't live in a densely populated city.

The only way to meaningfully control a free-market economy is to mix it with some socialism and have a constant rate of inflation. 4% works really well.

Deflation is the horror show, and that is why everyone in the government is on board with brrrr right now. Because if COVID knocks us into a deflationary economy, which by all rights it should, we now have real problems like Stagflation which is really a strange sort of deflation.

The average citizen is concerned about deficit spending, but they are on board because it makes the price of their one asset go up: their home's value.

The rest of the world is on board because it gives them a chance to invest in the single most reliable money thing which exists, more precious and reliable than gold or gems: US Treasury Securities, which are debt instruments.

It sounds like you believe the majority of voters then, must be smart people who understand how the money system works, otherwise the general population would be voting to curb government spending? Or am I over-simplifying things?
