What's new

How long is reasonable to wait on a shop?

Made an appt to talk with a lawyer.
Only took you 3 months! :flipoff2:
Of the 30+ lawyers I contacted in the last couple weeks, only 4 have called/emailed back and of those only 1 was interested in a visit.

Other ones said too busy, not in their scope, or their costs would far exceed the $$ owed.

Small claims was my plan, but the issue is I'm not sure how to sue, it was a single owner LLC that I paid, but the mower was a trade to the owner's husband and now it's sort of operating out of the LLC, off the books. LLC still exists though, business is expired.
I found out it's all in the wive's name, I've met her in passing and that's it.. Everything was done with the husband, who I thought owned the business.

If i don't get my winch back, it's well over felony theft.

Whats your end goal? Get $$ back? Fuck the guy over? something else?

You got the mog back. I think getting the mog back is a win since its not any worse for wear.

$3000 plus to replace the winch is another ~$2500
Do you have any documentation? Documentation is worth its weight gold in a courtroom. Otherwise, it's "he said - he said" and you're relying on luck at best.

EDIT: to clarify -
  • "Here's my receipt for the purchase of the winch on xx/xx/20xx"
  • "Here's proof that the winch was delivered to exocage guy on or about xx/xx/20xx"
  • "Here's proof I gave exocage guy x dollars on or about xx/xx/20xx"
    • Contract or at least documented correspondence showing x dollars given for x work.
Otherwise, the judge will likely be frustrated or pissed at your non-case.
