Got pounded hard in the rear by a BroDozer

That would be facts not claims.

I got an email saying my rate has gone up just under $40 per month and reason was for accident reported by Nexis Lexis

I called and spoke to a rep that confirmed that and told me "that it is just how it is"

I plan on calling back tomorrow or Tuesday when I get some time.

How many accidents have you been in? I had this happen to a friend and when his rates went up he was told it was because he had been in multiple accidents over the past 3 years. While none were his fault, the said he was now in a different risk pool based on the likelihood he would have to make an uninsured/underinsured motorist claim and that he lived in an area that was high risk for accidents. I told him it was BS and to change. He did change companies, but, when he shopped it, he found very little difference in price and was told he was in a higher risk pool and area so I guess they all do that BS. I am not sure how the law posted above affects that. Let us know what you find out.
 
I don't know where insurance companies stand now, but it used to be that if you were involved in an accident it was automatically 20% your fault no matter what because you were there instead of at home with your car parked in the garage. They said you took a risk driving your car that day.

Now that could be fought but it usually ended up in court or a day or two before court and it would settle removing that 20% of your liability.

Easy to win in court because it is civil and not criminal, so you only need 51% of the jury to agree that staying home was unreasonable, that you had a reasonable expectation of safety and arriving at your destination without incident. That the other driver was negligent in maintaining a safe speed or distance. Blah, blah, but stupid. So stupid.

The real victim becomes an evil person in the eyes of the other insurance company.

I have never made a claim before.

i have been hit 2 other times in the last 30 years and did not file a report for either.
 
I straight rear ended some poor lady on the freeway about 3 years ago and my insurance company did not raise my rates. Who knows with insurance companies? They have equations and algorithms and big brains squeezing every blood nickel out of us. Maybe they did the math and for every customer that leaves when they pull this shit ten stay at the higher rate?

One thing you can always count on is that Insurance companies will come out on top.

1995, I had a pimp ass 90 fullsize Blazer. Got a nice discount on insurance because "it's a SUV... its safer in accidents".

1996, I got a significant rate hike because "it's a SUV... its more dangerous to other vehicles in an accident".

In one year, went from cheaper than a comparable pickup to higher than a comparable pickup. Because safety.
 
My truck got clobbered in a parking lot and my rates went up. :laughing:

Under these conditions you could just as easily argue that he should be assigned to a lower risk pool.

I've tried the shop around thing just for shits and giggles. Every single insurance company website I visited asked the exact same questions and produced just about the same quote. The notion that competition exists in the auto insurance business is absurd.
 
24yrs old, 160#. Got rear ended by a late 80's S10 pickup at around 40mph. I was in a lifted 05 Tacoma with an All Pro rear bumper. Minimal external damage to the truck but my neck and back hurt. Got treated for 6 months and talked State Farm into a decent payout. 6 years later my neck and back is always in some kind of pain.

I would tend to agree. Moreso that shopping around always resulted in a lower quite until you compared coverage. When you make them give you the same coverage (not the bare minimum they are willing to write, similar deductibles, etc the pricing is very similar. My wife complains about insurance costs every few years and insists on searching. It always ends with the same results. I have heard for people with bad driving records or DUI that some companies "specialize in it" and are cheaper than others, but I have no experience with that.

It's almost like once you use laws to force people to buy insurance the entire market gets fucked up and the costs increase because there's no competition.

At this point in my life I don't care if it costs me another $100 a year. I stick with the agent that doesn't hassle me over dumb shit.
I call and say my windshield is chipped/cracked, he tells me to take it wherever I want and they write a check.
Wife hit someone in a parking lot 2 years ago, fucked the bumper cover on her volvo.
To the body shop, state farm wrote a $1300 check, premiums didn't change.
