I disconnected my doorbell two years ago and haven’t got around to fixing it yet guess I’m living dangerously now

They fully intended to kill him. They had a tracker on his car and he couldn’t exactly destroy evidence if he found out they were onto him. Instead of just grabbing him on his way to work while they raided his house they shot him dead after a no knock raid. At least if it’s criminals invading your house you have a chance to survive

You never watched 'cops' on tv when they are doing raids? It usually went something like this;
<KNOCK><KNOCK>"POLICE OPEN THE DOOR" battering ram engaged. Everybody piles in screaming different things at the same time ie: Don't move and get on the ground.
Right there, conflicting demands from some trigger happy jokeys.

I can not argue this, as it seems to be predetermined outcome when a no knock is happing to you as they're all giddy with the excitement of a state sanctioned murder.

He was crawling, crying, pleading. He reached back to pull up his shorts up once, they yelled not to reach back. His right arm moved in what would be a normal hands and knees crawling situation and the "You're Fucked" Dust Cover guy started the shooting and claimed it was him reaching for something.
But hey, his wife got $8M, all good. Right?

Timeline of raid​

  • Pre-raid: ATF agents can be seen on the home's doorbell camera covering up the camera
  • 6:02:58 a.m. A Little Rock patrol officer use his car's lights and siren to announce the presence of law enforcement
  • 6:02:59 a.m. ATF agents began knocking on the front door
  • 6:03:27 a.m. Agents use a ram to breach the door
  • 6:03:43 a.m. Malinowski fires the first of four shots from his Colt Defender .45 caliber semi-automatic handgun
  • 6:03:44 a.m. An ATF agent returns fire and is injured, shooting three times from his M4
  • Post-raid: Arkansas State Police officials search the home and surrounding area for evidence and interview witnesses

Justified force explanation​

Jones said in the press release that Arkansas law states a law enforcement officer is "justified in using deadly physical force if the officer reasonably believes that the use of force is necessary to defend himself or a third person from the use of deadly force."
Officers reportedly identified themselves by knocking on the front door and flashing the lights and sirens on a patrol vehicle before entering the home.

Officers were also wearing attire that readily identified them as either "ATF" or "POLICE" and so when the first agent was shot by Malinowski, Jones contends this gave the second agent a "reasonable belief" to use deadly force and return fire.
"Therefore, the use of deadly force by [the ATF agent] was in accordance with Arkansas and was justified," Jones said.

Was the lettering on the law enforcement jackets visible? Do they have to have a license plate light over the lettering? Or fluorescent lettering?

Were the lights on the police cruiser visible to the homeowner? Why would he have thought they were meant for him?

Did the ATF voices overlap, causing issues with clarity? How do you prove the homeowner knew they were police and intentionally shot at them?

Dunno but that was the report from the State AG. Don't know much about ARs AG.
