Has anyone gone through the legal process of claiming an abandoned vehicle?

Has anyone gone through the legal process of claiming an abandoned vehicle? Anyone that has done this, any estimate of the cost of doing so?

Looking at hiring a lawyer to do the work, as I have no idea what I am doing, and the inter webs is not much help.

Vehicle in question, 2019 Ford F-150, black, short bed, crew cab, 4x4, super crew 5.0L I believe. Looks mostly like a basic trim model, cloth seats, key start, drop in plastic bed liner, alloy wheels.

Truck has been sitting in the exact spot about five years, all four tires are flat, bags of top soil in the bed sprouted trees a few years ago, no keys, all doors and tail gate locked, I assume battery is dead, rotors rusted solid, still has the temp tag in the rear window, possible rodent damage there are seeds on the floor and seats. I am guessing it has less then 10k miles on it, maybe even less then 5K.

Short story, what I will tell the lawyer- truck is on my neighbors property parked their five years ago, home owners moved out two years ago (husband and wife) and I bought house and property, the husband passed away last year. I have contacted the pervious home owner a few times about getting it out of here and nothing has happened, last commutation I had with her she said “do what you want with it I don’t care”, that was in December, no commutation since.

Long story, not telling the lawyer, I heard this third person so I am not one hundred percent sure on the details, truck was owned by a friend of above mentioned husband and wife, the wife checked in on him every few weeks or so. The guy was hoarder and recluse locked himself in his falling down home, he eventually died in the house under a pile of trash and was found buy my neighbors’ wife; it was estimated he was dead about two weeks. The guy had no living family only person that knew him was my former neighbors. They drove the truck to their property and the house was so bad they had it demolished and is now an empty lot. I assume they were trying to get the title transfer to their name but since it was only a friend of the family it was almost impossible, and they put no effort into the lawyer route to do so.

Any suggestions will help thanks.
 
in WA you just take it to the state patrol they confirm its not stolen and give you paperwork for registration. after its registered for 3yrs in your name... you own it. no matter if its declared stolen after that. (had someone do that with a trailer)

call your state patrol or DMV. its state by state how the rules work.
 
You mean it's been parked on your property for 5 years.

Storage liens are much easier than abandoned ones.

Lawyer will have to check for bank liens. The bank will likely sign it over if you have 273,416 due in storage.

Good luck with it if the mice have gotten to it.

From what I have read, in PA you have three options, call state police they will impound it and eventually auction it off as abandon, transfer the title from the owner to new owner, go through the legal process of claiming abandon property. Two options are possible only one benefits me.
 
If its been there 5 years and its 5 years old, I can only see about a 1% chance it doesn't have a huge loan against it. I imagine as soon as an inquiry is made the bank will come get it.

I'd have a cop run a theft report for free before I paid a lawyer.
Sorry one part I left out, apparently he paid cash for this truck and is lone free, it only moved about a half mile form the original owner and is not hidden form the road. I am assuming it would have been repossessed by now.

If I report it to the police they will impound i and eventually auction it off, no benefit to me.

Yes parked for 5 years but I have only owned the property for the last two. I am thinking a lawyer may be my best bet. I am not sure on the storage liens, I will have to research that one.
 
in kansas I would file a mechanics lien on it. Let it sit here 120 days. Then post an ad in the local paper that it will be auctioned off on certain date at 4am. when no one else shows, I personally bid on it and buy it from my shop. Then I apply for a title with the docs supplied from the auction process and done. all washed and clean.



edit to add- I learned this week that ks changed the law. IF it sells for more than the "tow and storage" bill (assuming it has a "tow lien" on it)(also could be the same for a mechanics lien, idk) then the overage is supposed to be paid to the state. making the tow company or the shop whole and padding the coffers of the thieves. I mean bureaucrats. :flipoff:

Alternately, you don't have a truck on your property, just some parts from a truck. After sitting for five years, knowing what rodents do to wiring and how much wiring there is in a 19ish ford, it's more accurate to say you have parts than it is to say you have truck.

I have had people stop and ask me about it, I live on a dead end road and it is clearly visible from the road. Pretty wild to see a rust free new looking truck in PA that hasent moved in five years.

In Ak, you can use the abandoned vehicle process to get a title.
Go to the DMV, pay them $5, and they'll give you the address of the last registered owner.
Send a registered letter saying "Get your crap off my property."
Go by the address, and ask whoever lives there now to send the letter back.
Take the rejected unopened letter to the DMV, and they'll issue you a title.

My buddy has done that successfully with a handful of backyard motorcycles.

(a) In addition to removal of an abandoned vehicle under AS 28.11.020, a vehicle that is left standing or parked on private property without the consent of the private property owner and for a period of 30 days is presumed to be an abandoned vehicle and title to the vehicle may be transferred to the private property owner as provided under this section.

Yes on my property, I am researching storage leins now. I am keeping the area around it mowed and clean I am hoping it is not destroyed but it could already be a total loss.

Hmm good idea, the property is a abandon empty lot no so the letter should just be returned to sender. I will call the DMV on Tuesday, they are closed on Mondays in PA.

Start the storage fees from the time you bought the property or whatevers legal in your state. Put a lien on it for those fees.

I did a jet ski in calif. that way, it was easy
 
I've looked into it a few times for various shitboxes I was flipping. It varies by state. The easiest route will always be to "find" a bill of sale. If the last guy won't go looking for it you have nothing to worry about.

Hmm, good idea a bill of sale signed by both party's is legally binding in PA, I might be able to "find" a bill of sale.

As Tracy said in WA it's easy. Mechanics lien, storage fees etc make it simple. Personally here in WA I'd just talk to one of the county deputies that's always hanging around my brother's shop and have them so a little paperwork and it'd be in my name by the end of the week.


If there is a risk of the popo taking it and auctioning it off I'd definitely be looking at the lien option.
 
Hell yeah, looks like a decent truck! And this shows you've been conducting maintenance.
Yep the trees in the bed are growing quite well. I have a truck so I don't need this one, if I get it and like it I will keep it, as it is newer and far less miles, if I don't like it I will sell it and buy something I do like.
