Possibly, but it still opens up the door for future lawsuits that can use this as precedent.
It also will have enormous impact going forward on every single regulatory agency.
The lower court ruling on the sbr brace rule change was very similar to this and the Feds made damn sure that it didn't reach the SCOTUS for the same reason.
