Neighbor tree laws?

I am guessing the answer is no, but is there any laws/protection from trees that sre in your neighbors property?

My house has nothing but house next to mine has several BIG trees and another with four TALL palm trees (150 ft?)

Problem is when wind blows, it is from them to me, and it TRASHES my yard. I am talking really makes a mess on the ground and the pool. Its pretty bad.

Am I SOL, or is there anything concerning trees?
 
Unless they are hanging over your property you are probably SOL.
Last week we had high winds and leaves from trees a block away were blowing in my yard and piling up on the patio. I can’t make them come rake them up.

The only protection I know of is with regards to standing dead trees (snags). If they fall down and damage your property (roof, window, siding, fences...) you are shit out of luck and your homeowners policy comes into play. UNLESS you hire a certified arborist to come out and do a site inspection indicating the standing dead tree(s), write-up a report on their letterhead and send it registered mail to the owner/neighbor notifying them of the potential hazard to your property and due notice has been given. Then his HO policy has to eat it.

Currently dealing with this. They haven't fallen yet, but I cringe when they intend to do so. Challenge is where the property line is; I had my parcel surveyed and staked for this very reason. Problem is my arborist is so damn busy!
 
In my state/county I can cut the overhanging part as long as I don’t go on their property to do so and as long as it doest compromise the tree. You can be sued for replacement value of tree if you violate any laws
 
My grandmother bought her house in 1970something. Hers was the first one in the neighborhood in the middle of the hill with a commanding view of the Sakonnet River. Over time more houses came in and it got to the point where their trees blocked her view.

She made them take them all down because it was in the HOA rules. :lmao:
 
My Mom had a neighbor with a Redwood (of all things) that a previous owner had planted. It was about 15 feet off the PL, but when it got big it dropped "seeds" that would blow into her pool and stain the plaster. She went to court and said "I'LL PAY TO HAVE IT GROOMED EVERY SEASON!" Judge agreed and she paid about $500/year to have a trimmer come clean it up each year. This went on for about 15 years, IIRC. It got diseased and ultimately had to be cut down. It was about 40' tall and I got the rounds for free :smokin:

Just went through this with my neighbor, the one I hate. To the point I finally had to call the law on him to tell him to quit trespassing onto my goddamn porch over leaves from my trees in his yard. The cops had to remind him that there’s nothing he can do as TN law the burden falls on the him to trim my trees if they hang over his fence. We live in the mountains and everyone has trees in here and leaves from every tree blow into everyone’s yards. Yes I’d love to trim all of mine back but the last time it was as $3500 to do so and I have other shit to spend that money on.

Not generally. They're actually more like a giant blade of grass so they do bend and flex.
When they do go over it's something that pulls the entire root ball over.


I've seen some crazy winds that had them swinging all over and they were all fine later. They do generally grow in tropical coastal regions with regular high winds coming off the ocean. They are about the last things I'd worry about.

Ill admit, never seen one of those tall ass palm trees fallen over. But thats bizzare to me because they certainly seem like they would.

If it over hangs your yard, cut the part in your yard.

If its leaves blowing in your pool…. Sucks to be you. You should have paid attention when you bought the place or dug the pool.

All the ones I've seen blown over by the hurricane had the root ball attached.
I watched some of them bent over at 30ish degrees, but they held on
 
IF it makes you feel any better, I've got corn stalk drifts up against my fences and building from the fierce winds earlier this week. Some are 3 ft high or better. not my corn, but it's in my yard.
 
If they are notified they have a hazard tree that could fall on your house and it does, they cover it. If you don’t notify them or it’s all healthy trees and falls on your house, you cover it. You can trim branches overhanging your property. Those are your leaves, “act of God.”
