APPLETON (WLUK) --
Two people accused of killing a man in a Kaukauna home, wanted to make it look like a robbery gone bad, according to a criminal complaint.
Dontae Payne, 26, and Tanya Stammer, 29, were charged Wednesday with first-degree intentional homicide and armed robbery for the
death of Brian Porsche at a home on W. Division Street on March 30.
Payne’s bond was set at $1 million cash. A preliminary hearing date was not immediately set.
During her appearance, Stammer repeatedly offered expletive-laden comments to the court. At one point, she admitted to her participation in the crime when the issue of bond and where she lives was being addressed.
“I don’t plan on leaving and I do plan on following through with all of this. I’m going to hold my own. I will take accountability for my actions,” she said.
At that point, she was advised to stop talking to avoid incriminating herself, to which she replied: “I just did.”
When her bond was set at $1 million cash, she responded with more expletives. A preliminary hearing is set for April 14.
According to the criminal complaint, Porsche had his hands up while Stammer was pointing a gun at him.
Tanya then said, "Get me everything." She explained that she wanted it to look like a robbery gone bad. She wanted him to get shot in the leg, to scare him. While he was standing, (Porsche) went into the kitchen and was told to get a coffee can of money in the cupboard. Tanya knew about the coffee can prior to going there. (Porsche) then took the money out of the can and handed it to Tanya. Tanya said she saw a change jar and told (Porsche) to give her the change jar, which he did. Tanya then told (Porsche) to get back on the couch and while he was sitting back down, (Porsche) swatted at the gun, but didn’t knock it out of her hands. Tanya then backed up a little bit and (Porsche) then said, please don't do this. She then said, "And then, boom and he fell into the couch.
Stammer said Paine was the one who shot Porsche.
Another witness, who was traveling with the two that day, quoted Stammer as saying “the victim swatted at the gun and then (Paine) took the gun from Tanya and shot the guy,” according to the complaint.
Paine’s story to police differed. According to the criminal complaint:
Dontae said Tanya never handled the gun and Dontae shot the man in self-defense because the man was so big and trying to get Dontae's gun. Dontae said the man was standing up when Dontae shot and he fell into the chair after the shot but Dontae thought the man was still breathing when Dontae left. Dontae said it just happened and the shot was a pretty "close shot."
The two took about $575 in cash from the home, as well as Porsche’s cell phone & keys – which they tossed in Lake Winnebago. Police later recovered the phone.
The complaint also cites a social media post by Paine made a few days after the murder, a photo of the words " I got murder on my mind".
Porsche died of a single gunshot wound to the head.
