Gun Trust (class 3)

In the past a lot of people went through and set up a trust to avoid having to have the chief law-enforcement officer sign off on a stamp for a class III firearms. Is that still necessary? Or did the loss or restrictions change?

What is the current laws situations around tax stamps and paperwork?
 
Not sure about it if you don’t have issues with the CLEO sign off, from what I’ve found there are ups and downs to it.

Technically, you aren’t supposed to have class 3 items in the possession of any unauthorized persons, meaning if it’s in your safe, you’re gone, and your wife knows the safe code and is home, you’re in violation, but apparently this has never been an issue.

Flip side to it was a guy who posted the other week that he was trying to remove his wife as a member of the trust as they were getting divorced.

I’m primarily interested in it as a means to pass items that will eventually be banned onto my sons, but they are 2 1/2 and 8 months, so they can’t be a legal heir until they are 18. Who knows that will be possible in that time frame.

The “go to guy” for them was Sean Cody in Houston, but he passed away earlier this year.

Silencer Shop has been advertising their “one shot” trust which is apparently a trust for each individual item and avoids the pitfalls of creating one, I don’t think it has many of the benefits either, but might solve the CLEO signature if yours is a socialist.
 
Was there another change? Like everyone on the trust needing a background check or something?

I’m confident that my close friends and family are smart enough to not commit felony gun crimes.

im that guy. Im talking to a lawyer whos a buddy and a gun nut here just as soon as judge signs off on the divorce papers. I wasnt going to use the buddy when i started the other thread on pirate cause i figured ex was gonna suck( ya you are thinking the right way) him into being her lawyer,however he told her to get bent so we did it with out lawyers( she thinks).
 
E-filing a Form 1 for a trust is the fastest route to a tax stamp, typically under 60 days, versus 10 months filing paper as an individual.
 
And Ohh BTW there are class III dealers but there are no class III firearms.

The firearms are known as Title II.


No matter how many times you see class III firearms on some idiots website, when you start filling out the trust indenture make sure you use the proper terms or it will get kicked back or not be valid.

What I have stated can be verified if you have half a brain, But somehow I doubt you would go in that direction just blab about what some else says accusing of not owning any nfa weapons.

I do own nfa weapons and have the form 3's but im not posting personal info on this or any other forum for pirate4x4 kind of idiots to grab and make use of.

I'm not arguing that licensing doesn't exist. It's the false notion that a license is required to personally own NFA weapons, as licensing is only required for those "engaged in the business" of firearms manufacturing, import/export, gunsmithing, and sales, with an SOT for those dealing with NFA weapons.

And I think you misunderstood me. I wasn't making my comment to attack you. I agree with you.

Form 1 E forms are under 4 weeks for trusts and individuals and have been for 5-6 months. 2 weeks is really common.

After 10 years as a SOT I had enough, got out of the so called business, as it had turned into a hobby.

And to the point (sorry I was overwheoved for a second) the only thing thats objectionable aka 2nd amdt violation is a tax stamp cost of 200.00 to purchase a Title II firearm.

RTKBA one shouldnt have to pay a tax to exercise a right.

I'ma firm believer in repealing the NFA entirely. Machine guns are artificially prohibitively expensive for most people, and I agree that we shouldn't have to pay a $200 tax to own weapons that we are entitled to and which serve the intended purpose of the Second Amendment better than weapons we are "allowed" (I hate saying that) to own under the law. I want an M60E6, and that should be left between me, my LGS, and my bank account, without having to ask, "If it pleases the crown, may I purchase a machine gun that is as old as I am and costs 10x more than it should new?"

I think that was the point. If you could even register a new mg they'd be barely more than their semi-auto counterparts. The supply and demand has created an artificially inflated market.


I'm 100% behind repealing the NFA. A tax on a constitutional right is bullshit and always has been.
