Crossing Railroad tracks

Have a piece of property with a deeded right of way for access. It had an asphalt crossing at one time, RR removed it prior to owning the property . We have been crossing, put rock up to and in center of tracks. RR has taken it out a few times. Have sent E-mail to RR with no response. Anyone dealt with RRs? Know of RR ROW lawyer?
 
Active track, I would assume?
Put in asphalt to their specs?

I had a customer that was at the end of a city street, tracks at the end of the Street. The RR got into it with them about a new crossing and pulled the road. For a year I had to turn at the main road's railroad crossing and drive the semi down the right-of-way to reach the customer. The other driveway had a light pole preventing turning from the other street.

Good luck. I’m surprised they didn’t threaten legal action for putting rocks up to/in the middle of the rails. I haven’t had to deal with the RR personally but have heard horror stories from contractors that have. They are assholes about their ROW’s.
 
To me the hell of it all is I have a deeded ROW through there. Got hung on the tracks one night. Finally got cell service,got call through to someone and stopped trains for 5-6 hours. Expected to hear from them then. Nothing. Lady answering phone just thanked us for calling.

They give zero fucks. They'll pull crossings whenever they see fit.

You’re going to have better luck fighting with the government than fighting with the rail roads

Might want to ask them the specs they are okay with for crossing or cut the rails and burn one of their locomotives with a dump truck full of thermite to establish dominance. Might want to hire [486] to buttsecks up their negotiator while you're at it.
 
You can spend $20k on a lawyer and get it established 4-10yrs from now,, or $2k on a pile of gravel (assuming you have access to FEL) that will last 20 years and just re-fix it every year when the cleaning crew comes through.

We have used the rock they have piled near the crossing . They used a backhoe the first time. Last three times they have used a huge MFer that cleans the rock out of the center and leaves a windrow on either side. This is all since August.

That's typical track maintenance.

mix in a couple bags of cement and sand next time you replace the gravel
if you wanna be all nice and shit, drag a 2x4 on the inside of the rails so it clears the wheel flanges

Maybe don't use their ballast pile to build a crossing next time?

Take a copy of the deed down to the local yard and talk to someone in person. My guess is they no longer have a record of that being a crossing if it was removed. Shouldn't be a big deal for them to have a work crew come through and slap something in.

I don't know who the RR had for lawyers but if I ever need one I want one of theirs! They have shit tied up for lifetimes. Hell the local lumber yard has to cross the tracks to get to their storage of lumber, there are signs stating it's a private crossing to cross at your own risk.

Went down, talked to the track super, he said no problem. Be there in a week. Two weeks later he said that there is nothing he can do, need to talk to Jacksonville. They do not return calls or emails.
 
Trust me, when the railroad surfacing gang comes through, unless that crossing is marked on their track charts or on board GPS they are going to take it out every time. You might have better luck talking to the supervisor of the track gang next time they come through, he can put you in touch with the division engineer, thats the person who can get your crossing marked.
